Experience

Gonzalo joined Cariola in 1997 and became a partner in 2009. He heads the Regulatory Law Group, that includes the areas of environment, energy, utilities and administrative law. He serves as legal counsel for local and foreign companies in infrastructure projects, including the legal aspects of environmental impact studies, concessions, permits and other governmental authorizations, construction agreements, energy and capacity supply agreements, disputes arising from contractual relationships on supply of energy and/or fuel, and dispute resolution before administrative agencies, the regular courts of law, or arbitration courts related with utilities, energy and environment, among other matters.

Relevant experience:

  • Legal advice to various local energy off-takers in bidding processes for the purchase of energy and capacity from generation companies;
  • Assistance in regulatory, electricity and environmental aspects in the development of greenfield generation projects, both conventional and non-conventional.
  • Legal due diligence and subsequent purchase of greenfield and brownfield generation projects, including thermal plants, hydro plants, solar and wind farms, geothermal concessions and small distributed generation plants.
  • Representation of local generation company before the Expert Panel of the General Law of Electricity Services in connection with a dispute related to the ownership of expansions of the transmission system.
  • Legal advice on the negotiation of energy transmission agreements;
  • Assistance in the negotiation of agreement for the connection of power plants to the national grid;
  • Work with various generation companies in public bidding processes for the sale of energy and capacity to distribution companies;
  • Negotiation of joint ventures and agreements for the development of energy generation projects;
  • Advice in the legal aspects of the environmental impact assessment of industrial projects, including the filing of claims before administrative agencies and environmental courts;
  • Defense of local companies in sanctioning processes initiated by Superintendencia del Medio Ambiente (SMA), Superintendencia de Electricidad y Combustibles (SEC), and the Health Authority;
  • Legal advice in the process for the purchase of water utility companies;
  • Legal due diligence and subsequent purchase of greenfield and brownfield generation projects, including thermal plants, hydro plants, solar and wind farms, geothermal concessions and small distributed generation plants.
  • Representation of local generation company before the Expert Panel of the General Law of Electricity Services in connection with a dispute related to the ownership of expansions of the transmission system.
